All models posing for and appearing on www.thewarmproject.com were over 18 years old at the time of shooting. Not all material on www.thewarmproject.com relates to the provisions of 18 USC section 2257 and 28 CFR 75. All sexually explicit material including images, gifs, videos or other on www.thewarmproject.com are being published pursuant to 18 USC section 2257.

This section contains the terms and conditions on which www.thewarmproject.com operates. By choosing to support this project either by a direct donation, a purchase from the website shop at www.thewarmproject.com or by becoming a member of www.thewarmproject.com, you agree to be bound by those terms and conditions.

The Warm Project is a creative project based in Athens, Greece that explores the male nude and its relationship to the real three-dimensional space around it. The aim of the project is to capture the form and volume of the nude body and the space it occupies and reproduce them in scale, in the real, physical three-dimensional space using printed images and a technique who’s outcome resembles the pages of a pop-up book.

TWP’s principal product - which is for sale at the website shop - is a painted rectangular frame, that contains a photographic three-dimensional elevation of a man in the nude inside the frame’s scaled three-dimensional space.

The Warm Project is primarily an art project – not a porn website.  However the imagery produced for this project is of a nude nature that can sometimes be rather explicit. The initial photographic material used for TWP’s work, is produced here in Athens at TWP’s photographic studio of young - mostly Greek guys - aged 18 to 28, who don’t mind being photographed in the nude and it is to that visual material that paid members have access. 

To donate to The Warm Project, buy work from www.thewarmproject.com or become a member of the same website you should acknowledge the following:

Age

You must be at least 18, or the legally required age in your country (or territory) to view sexually explicit images and legally capable of entering into binding contracts. You must not attempt to access www.thewarmproject.com from a city, state, province, county, country, or locale in which possessing, viewing, or distributing adult material is illegal.

Personal interest

You should not find images of nude and/or sexually aroused adults, adults engaged in sexual activity, or other sexual material offensive or objectionable but clearly wish to view such material and have a personal interest in the material published on www.thewarmproject.com.

Personal details

When entering details on www.thewarmproject.com you should always make sure the information about you is full, correct and updated including but not limited to, your full legal name, your address, your contact details and your credit card, bank, or other financial details. If we are unsure that the information you have provided is correct or legal, we have the right to make queries and you agree to provide us with answers that to your knowledge are correct. We may reject any membership application, donation or sale at the website’s shop if we deem that your answers are not satisfactory.

Intellectual rights

By becoming a member of www.thewarmproject.com, you are given access to The Warm Project’s visual material for your own personal use on your personal computer or mobile device. You may download the material on www.thewarmproject.com, however becoming a member of the website does not grant you the right to upload, post, share, trade, republish, transmit, reuse, decompile, reverse engineer, modify or resell this visual material in any way or with others. Unlike the visual material on the website, physical items bought from the website’s shop including artwork, garments, posters and other printed material can be physically donated or passed on to third parties. In addition you may not use any of the visual or physical material on www.thewarmproject.com for commercial purposes. You also agree not to share any material from www.thewarmproject.com with minors. All intellectual property rights to the material on www.thewarmproject.com, including but not limited to images, gifs, videos, artwork, garments, prints, texts and logos belong to The Warm Project unless stated otherwise. You may republish unedited and referenced work by The Warm Project only after getting in touch with us on +306988486318 or on info@thewarmproject.com.

Login credentials

The login credentials chosen by you or being provided by the system on signing up as a member on www.thewarmproject.com are confidential. You may not disclose this information to any third party no matter how close that may be. It is your responsibility to keep your login details safe and private. We have the right to terminate your membership or disable and/or block your username or password at any time, if in our opinion you have failed to comply with any of the provisions of these terms and conditions.

Donations

Donations to The Warm Project are very welcome. We use every help that reaches The Warm Project to stage more photo shoots, which are the starting point of our creative work and we highly appreciate those that take the time and resources to support us in that. We don’t give rights to the creative process to those that choose to donate to The Warm Project, however there is a reward scheme in place. Shop prices and delivery

The prices of items for sale at the shop on www.thewarmproject.com are fixed and may differ from prices found for the same items in other points of sale. No credit or refunds can be given for purchases from the website’s shop for items that are not faulty. However returns may be accepted on our discretion depending on the state of the returned goods. All items are sent via the Greek Post (ELTA) on registered and insured mail. We will not be responsible for delays or losses of items in post for reasons beyond our control, however we will do our best to assist our customers in tracing items and/or claiming insurance. 

Prohibited uses

You may not use the visual or physical material on www.thewarmproject.com in a way that breaches the applicable local, national or international law or regulation, in a way that is unlawful or fraudulent or has an unlawful or fraudulent purpose or effect such as to harm minors in any way, to harm the personality and reputation of the guys posing or working for The Warm Project or to threaten, abuse or invade their privacy, to cause them annoyance, inconvenience or needless anxiety, to harass, upset, embarrass, or alarm them in any way. You may also not use this material to promote violence or discrimination based on race, sex, religion or lack of religion, nationality, disability, sexual orientation or age against them or against others. You also agree not to attempt to access the members’ pages of www.thewarmproject.com without authorization, to interfere, damage, or disrupt any part of www.thewarmproject.com, any equipment or network on which www.thewarmproject.com is stored, any software used or any equipment, network or software used by any third party. You must not misuse www.thewarmproject.com by knowingly introducing viruses, Trojans, worms, logic bombs or other code, which is malicious or harmful. You must not attack www.thewarmproject.com via a denial-of service attack or a distributed denial-of service attack. Breaching this provision is a criminal offence under the Computer Misuse Act 1990. Any such breach can be reported to the relevant law enforcement authorities with a disclosure of the relevant IPs and/or identities. You may not link to www.thewarmproject.com from a website in way that is not fair and/or legal, that aims to damage our reputation or take advantage of it and you must not establish a link that may suggest an association, approval or endorsement on our part where none exists. Our website must not be framed on any other website. We reserve the right to withdraw any such linking without notice.

Liabilities

We will not be liable to damages brought to servers, computers, or other networked systems due to malicious code that may be found on our systems. Although we constantly make sure our systems are free from viruses, Trojans, worms, logic bombs, or other malicious code, it is the end user’s responsibility to safeguard their system from such threats. www.thewarmproject.com is not a porn website and paid members should not expect updates to always happen on a regular and timely manner, but irregularly depending on model turn-up. We will not be liable or responsible for any failure to produce work for events outside our control. This includes any action, non-action, omission or accident such as (but not limited to) lack of interest to pose for The Warm Project, violent actions against The Warm Project’ people and/or facilities, strikes, riots, terrorist attacks, war, fire, storm, flood, earthquake, or other natural disaster, impossibility of use of railways, ships, aircrafts, motor transport, or other means of public or private transport. We will do our best to bring those events to a close, however production will be suspended for the duration of those events. The Warm Project is a dynamic work of art and material on www.thewarmproject.com can move and change at any one time without notice. This is an important aspect of our creative process and does not make us liable to cancelations or refunds. Links on www.thewarmproject.com to other websites are provided for your information only. We accept no responsibility for them or from any loss or damage that may arise from using them. We make every effort to keep www.thewarmproject.com up and running 24 hours per day, 7 days per week however servers, pipelines or hubs do go down possibly making www.thewarmproject.com unreachable. This does not make us liable for damages or refunds.  Server failure is a given which usually does not last long. You must understand and accept the responsibility of your own actions and hereby release the creators of this site from any and all liability.

Membership prices and payment

Membership prices to www.thewarmproject.com are listed on the join page of the website and can change without further notice. All sales are final. Membership can be paid in cash with a visit to The Warm Project’s studio in the center of Athens, Greece in which case a receipt will be handed in person, via a cash deposit to our Greek bank account in which case the receipt is mailed by post or online with a credit card via CCbill. Cash  deposits to our Greek bank account are cleared manually and when initiated from abroad can be rather expensive as they often carry extra charges. They also take a few working days to clear. Otherwise deposits from within Greece do not normally carry extra costs and – depending on the time and day of the deposit – can be completed faster. Online CCbill payments are instant.

Changes to the Terms and Conditions

We have the right to revise and amend these Terms and Conditions at any time and it is our obligation to make it clear on the website’s “ENTER” page and at the beginning of the “Legal” page that the Terms and Conditions have changed. Clicking on the “ENTER” button of the website’s first page is a direct acceptance of those Terms and Conditions with any changes that may have taken place.

Privacy policy

www.thewarmproject.com collects info such as names, addresses and contact details when signing up as a member or when making purchases from the website shop (we do not collect credit card details, these are cleared through CCBill) and information in the form of “cookies” that we anonymously collect while browsing the website to make it easier, faster and friendlier to use - none of this information (cookies) is ever connected to personal details or emails. Personal details are never shared with third parties. 

Complaints policy

Reporting Content Violations

Members or visitors of thewarmproject.com (users) are welcome to report any content on our website that may be deemed illegal or violates our Standards. Reports can be submitted by email on info@thewarmproject.com.

Review and Resolution Timeline

All reported complaints will be acknowledged, reviewed, and resolved within seven business days from the date of submission.

Review Process

The review process involves a comprehensive examination of reported content. We will assess the reported material based on our established Standards and guidelines.

Appeals Process

Users have the right to appeal any decisions made during the review process. Users will be notified of the outcomes by email. Appeals must be submitted within two business days following our initial email and the appeals process will be conducted impartially by a different team (external legal advisor or otherwise depending on the matter).

Potential Outcomes

Following investigations and reviews, potential outcomes may include content removal, warnings, temporary suspension, or permanent suspension of user accounts, depending on the severity and recurrence of violations. As before, users will be notified of the outcomes by email.

Confidentiality

All information provided during the complaints process will be handled confidentially, in accordance with our Privacy Policy.

Model appeal procedure

All models posing for thewarmproject.com sign a consent form for every separate photoshoot, however any person depicted in the content of thewarmproject.com can appeal to remove such content and have the content removed should the outcome of the investigation determine that consent was not given or is void under applicable law. Any disagreement regarding a model’s appeal will be resolved by the Greek courts in the prefecture of Athens.
